Privacy Policy

DJP Athlete ("we", "our", "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information.

1. Information we collect

A. Information you provide directly

  • Identity and contact: name, date of birth, address, phone, email, emergency contact;

  • Health and fitness: PAR-Q answers, medical history, medications, injuries, pregnancy status, training history, body measurements, performance test data, photos or video used for technique review;

  • Goal and lifestyle information: training goals, sport, sleep, nutrition, lifestyle factors;

  • Payment information: when you pay, our payment processor collects your payment details. We do not see or store full card numbers;

  • Communications: any message, form, or document you send to us.

B. Information collected automatically

  • Site usage: IP address, device and browser type, pages viewed, referring page, and similar log information;

  • Cookies and similar technologies on the Site, where applicable, including any analytics or marketing tags we use.

C. Information from third parties

  • Coaching apps and platforms (for example, training-app providers, video conferencing tools, calendar/booking tools) that you use to interact with us;

  • Referrals from coaches, physicians, or sports organisations who introduce you to us, with your consent.

Health information note. We are not a HIPAA “covered entity”. The health information you share with us is treated as sensitive personal information and protected as described in this Policy, but it is not subject to HIPAA. If you receive medical care from a HIPAA-regulated provider, that provider’s notice of privacy practices governs that data.

2. How we use information

We use your information to:

  • Assess your readiness, design and adjust your programme, and deliver in-person, online, testing, and clinic services;

  • Communicate with you about scheduling, sessions, and progress;

  • Process payments, send invoices and receipts, and keep tax and business records;

  • Respond to enquiries and provide customer support;

  • Send service-related notices and, where you have opted in, marketing emails (you may opt out at any time);

  • Run, secure, and improve the Site and our services;

  • Comply with legal obligations and defend legal claims, including in connection with the Liability Waiver and Client Services Agreement.

3. Legal bases (for clients in jurisdictions that require them)

Where applicable, we rely on: performance of a contract with you; your consent (which you may withdraw at any time); compliance with a legal obligation; and our legitimate interests in operating, securing, and improving the business, balanced against your rights.

4. How we share information

We do not sell your personal information. We share it only as follows:

  • Service providers acting on our behalf, including payment processors, scheduling and booking platforms, training and video apps, email providers, cloud storage, and accounting services, all under contracts requiring appropriate confidentiality and security;

  • Healthcare providers or emergency responders, if necessary to protect your health or safety, and only with your consent except in a genuine emergency;

  • Professional advisors such as our attorneys, accountants, and insurers, where reasonably needed;

  • Authorities and other parties where required by law, subpoena, or legal process, or to establish or defend legal claims;

  • A successor entity in the event of a sale or reorganisation of the business, subject to this Policy.

5. Storage, security, and retention

We use reasonable administrative, technical, and physical safeguards to protect personal information. No system is completely secure, and we cannot guarantee absolute security. We retain personal information for as long as needed to provide services, comply with legal, tax, and accounting obligations, and resolve disputes — typically up to seven (7) years after our last engagement with you, unless a longer period is required by law.

6. Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you;

  • Correct inaccurate or incomplete information;

  • Request deletion of your personal information, subject to legal exceptions;

  • Opt out of marketing communications;

  • Opt out of any “sale” or “sharing” of personal information for cross-context behavioural advertising (we do not engage in either);

  • Limit the use of sensitive personal information beyond what is necessary to provide the services you request;

  • Receive a portable copy of your information; and

  • Be free from retaliation for exercising any of these rights.

To exercise any of these rights, email darren@darrenjpaul.com. We will verify your identity using information already on file. You may also designate an authorised agent to act on your behalf in accordance with applicable law.

7. Children

We work with minors (under 18) only with the written consent of a parent or legal guardian, who signs intake and waiver documents on the minor’s behalf. We do not knowingly collect personal information from a child under 13 except through that parent or guardian. If you believe we have done so, contact us and we will delete it.

8. Cookies and analytics

Our Site may use a small number of cookies and analytics tools (for example, basic site analytics) to understand how the Site is used. You can control cookies through your browser settings. Where applicable law requires consent for non-essential cookies, we will request it through a cookie banner.

9. International transfers

We are based in the United States and process personal information here. If you contact us from outside the United States, your information will be transferred to and processed in the United States, which may have different data-protection laws than your country.

10. Changes to this Policy

We may update this Policy from time to time. We will post the updated Policy on the Site with a new “Effective” date and, where the change is material, take reasonable steps to notify you, for example by email.
